Statement of risk
PURCHASERS OF THE BACKAPP CHAIR ARE REQUIRED TO READ THIS STATEMENT OF RISK AND THE ENCLOSED INSTRUCTIONS ON ASSEMBLING AND USING THE BACKAPP CHAIR PRIOR TO ACTUALLY SITTING ON THE CHAIR.
THE BACKAPP CHAIR IS AN UNSTABLE SITTING PRODUCT AND AS SUCH, USE MAY RESULT IN SEVERE INJURY OR EVEN DEATH. DO NOT LET CHILDREN SIT ON THE BACKAPP CHAIR. THE PURCHASER ASSUMES ALL KNOWN AND UNKNOWN RISKS OF SITTING ON THE BACKAPP CHAIR. BACKAPP.EU ASSUME NO RESPONSIBILITY FOR ANY INJURIES CAUSED BY THE USE OR MISUSE OF THE BACKAPP CHAIR.
FURTHER, THE PURCHASER SHOULD NOT ALLOW OTHER INDIVIDUALS TO USE THE BACKAPP CHAIR AND ASSUMES ALL RESPONSIBILITY FOR INJURIES CAUSED BY NON-PURCHASER USE.
Severe injuries may result if one or more of the following conditons are present:
1. More than 250 pounds are placed on the Backapp Chair. This includes a person who weighs more than 250 pounds;
2. The Backapp Chair is not correctly assembled;
3. The individual user has balance issues; and
4. The Backapp Chair is sitting on a soft surface, such as a plush carpet.
DO NOT SIT ON THE BACKAPP CHAIR IF YOU HAVE CONSUMED ANY ALCOHOL, ARE FEELING DIZZY OR OFF BALANCE OR IF YOU HAVE ANY MEDICAL CONDITION THAT MAY INCREASE YOUR RISK OF FALLING OR MAY INCREASE THE CHANCE OF INJURY SHOULD YOU FALL.
Warranty
Backapp.Eu. provides the following warranty, except as described below.
Product Guarantee – 30 day money back
If within 30 days and for whatever reason you are not satisfied with the Backapp Chair, you may return it for a full purchase price refund. NOTE: The Backapp Chair must be returned undamaged and in its original packaging.
This warranty extends only to the original purchaser who buys new product from Backapp, its subsidiaries, or its authorized resellers. Please visit our website for more details on how to apply for a repair – www.Backapp.com. NOTE: In order to submit a claim your will need: (i) a copy of the invoice, (ii) a photo(s) of the damaged part(s); (iii) a photo of the label on the chair with the production date and serial numbers; and (iv) a statement in regard to your normal use of the chair.
Any misuse, abuse, or modification to the original product voids the warranty.
The warranty period starts from the date of purchase.
This document inclusively describes all of the warranties given and remedies available with respect to the company’s products and services. Backapp.Eu and its subsidiaries and its wholesalers and resellers disclaim any other warranty whether express or implied, statutory or otherwise, in relation to the products. Backapp .Euundertakes no responsibility for the quality of the goods except as otherwise provided herein. Backapp assumes no responsibility that the products will be fit for any par7cular purpose for which you may be buying this product, except as otherwise provided herein
Backapp does not warrant:
• changes in surface finishes due to aging or exposure to light
• marks, scars, or wrinkles occurring naturally in leather
• failure resulting from normal wear and tear
• pilling of textiles
TO THE EXTENT ALLOWED BY LAW, ANY IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED AND TO THE EXTENT THEY ARE LEGALLY REQUIRED, ARE LIMITED IN DURATION TO THE DURATION OF THIS WRITTEN WARRANTY. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTON ON THE FACE HEREOF AS SET FORTH IN UCC §2-313 through §2-316.
BACKAPP SHALL NOT BE LIABLE FOR LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
Applies in US only: Some states do not allow limitations on how long an implied warranty lasts or do not allow the exclusion or limitation of incidental or consequential damages, so the limitations or exclusions in the two preceding paragraphs may not apply. This warranty gives the purchaser specific legal rights; however, the purchaser may also have other rights that may vary from state to state.
